Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of certiorarified Mandamus, to call for the records pertaining to the impugned order in O.Mu.No.1067/Aa5/18 dated 04.04.2018 on the file of the respondent and quash the same as illegal and consequently for a direction, directing the respondent to approve the appointment of the petitioner dated 29.09.2008 in the post of Office Assistant with all consequential benefits within the time period stipulated by this Court.

ORDER

This Petition coming for hearing on this day and upon perusing the grounds of petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.Lajapathi Roy, Advocate for the Petitioner and M/s.S.Srimathy, Spl.Government Pleader on behalf of the Respondent and this Court made the following order: Pursuant to the statutory notice issued, the respondent appeared today. However, the learned Special Government Pleader appearing for the respondents submits that, as against the order passed by the writ Court dated 17.07.2018, where eight weeks time was given to comply with the order, belatedly, the writ appeal has been filed on 19.07.2019 with condone delay petition. Till 19.07.2019, what steps have been taken towards complying the order has not been explained by the respondent. No statement/affidavit or counter has been filed. https://hcservices.ecourts.gov.in/hcservices/

In view of the same, the respondent shall file an affidavit explaining the sequence of events taken place, steps taken pursuant to the order passed by this Court dated 17.07.2018 in W.P.(MD) No.15429 of 2018 and such explanatory affidavit shall be filed by tomorrow. Post the matter on 07.08.2019. The respondent shall remain present on that day.
