ORDER : The Court Made the following order :- This petition has been filed to modify the condition imposed in Crl.O.P(MD).No.3108 of 2026 dated 23.02.2026 in Paragraph 6(b) of the order.
2. The learned counsel for the petitioner submitted that the petitioner has filed Crl.O.P(MD).No.3108 of 2026 seeking anticipatory bail. After hearing both sides, this Court had granted anticipatory bail to the petitioner on 23.02.2026 with certain condition, the one of the condition is extracted as follows:
The petitioner is directed to deposit a sum of Rs.2,00,000/- to the credit of Crime No. 30 of 2026 before the learned Judicial Magistrate, Thiruppathur. On such deposit, the learned Judicial Magistrate, Thiruppathur, shall accept the sureties furnished by the petitioner. After receipt of entire amount, the learned Judicial Magistrate, Thiruppathur, shall deposit the said amount in an interest bearing Fixed Deposit in any nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.30 of 2026. Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment. The learned counsel for the petitioner submitted that due to the financial crisis, the petitioner is unable to deposit a huge amount and seeks to modify the above said condition.

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that this Court passed the order on merits after hearing the learned counsel for the petitioner and the aforesaid condition was imposed. It is the duty of the petitioner to comply with the order of this Court without fail. Hence, he vehemently opposed the modification of the condition.
4. Heard both sides and perused the materials available on record.
5. Considering the facts and circumstances of the case, the reasons stated in the affidavit filed by the petitioner, the fact that the petitioner does not possess a huge amount and the nature of the offence, this Court modifies the condition imposed on the petitioner in Crl.O.P(MD).No. 3/5
3108 of 2026 dated 23.02.2026 in Paragraph 6(b) to the effect that the petitioner is directed to deposit a sum of Rs.1,00,000/- to the credit of Crime No. 30 of 2026 before the learned Judicial Magistrate, Thiruppathur. On such deposit, the learned Judicial Magistrate, Thiruppathur, shall accept the sureties furnished by the petitioner. After receipt of entire amount, the learned Judicial Magistrate, Thiruppathur, shall deposit the said amount in an interest bearing Fixed Deposit in any nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.30 of 2026. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment. All other conditions imposed by this Court shall remain unaltered.
