ORDER

This petition has been filed seeking a direction to the respondents to provide adequate police protection for the life and limb of the petitioner and her family members, as well as for the property situated in Survey No.100/4B, Sankaranarkudikadu Village, Thiruvonam Taluk, Thanjavur District, measuring an extent of 4 cents, by considering the representation dated 19.01.2026.

When the matter was taken up for hearing, the learned Government Advocate appearing for the respondent police submitted that two FIRs have already been registered in Crime Nos. 338 of 2025 dated 11.12.2025 and 344 of 2025 dated 27.12.2025, respectively, at the instance of the petitioner against one Parveenasuki and others. However, as regards the representation made by the petitioner, as pointed out by the learned counsel for the petitioner, the same has not yet been received by the third respondent.

It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon him to consider the same on its own merits and pass appropriate orders in one way or other, instead of keeping the same pending indefinitely. As such, non-consideration of the 2/4

representation by the Statutory Authority would amount to dereliction of duty and hence, this Court will be justified in invoking its extraordinary powers under Article 226 of the Constitution of India and direct them to consider the same within a stipulated time.

Since the learned Government Advocate appearing for the respondent police submitted that no representation has been received so far, the petitioner is granted liberty to submit a fresh representation seeking the aforesaid relief to the third respondent forthwith. On receipt of the same, the third respondent police is directed to consider the same, on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents to consider the same on its own merits.
