Respondent / Respondent Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to suspend the sentence of imprisonment imposed in SC No.7 of 2021 on the file of the learned Sessions Judge, Karur, dated 19.04.2022 and enlarge the petitioner/appellant on bail, pending disposal of the above Criminal Appeal.

To call for the records of the Court below and set aside the judgment and convictio dated 19.04.2022 made in S.C.No.7 of 2021 on the file of the learned Sessions Judge, Karur and acquit the Appellant / 5th Accused.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.DEENADHAYALAN S, Advocate for the petitioner and of Mr.E.ANTONY SAHAYA PRABAHAR, Additional Public Prosecutor, on behalf of the Respondent the court made the following order:- (Order of the Court was made by R.SURESH KUMAR, J.) The earlier petition seeking suspension of sentence filed by the very same petitioner, having been considered, was dismissed as withdrawn on 19.12.2022, wherein the plea raised by the petitioner, seeking parity with the co-accused, having been considered, was about to reject. CRL MP(MD) No.6310 of 2023 to withdraw the petition and the same was dismissed as withdrawn on 19.12.2022.

2.Though the date has been fixed sometime in February, 2023 to take up the main appeal, due to want of time it could not be taken up. Therefore, we feel that this petition can also be dismissed by fixing the date sometime in June 2023 for final hearing of the main appeal. Accordingly, this Criminal Miscellaneous Petition is dismissed.
