ORDER

This petition is filed for a direction to the learned Judicial Magistrate No.II, Dindigul to expedite the trial and dispose of the case in C.C.No.524 of 2017, within a time limit.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent.

3. According to the petitioner, after marriage, the petitioner was living in her matrimonial home with her husband and in-laws in abroad. At that time, the proposed accused persons have demanded additional dowry and also caused mental torture to her and forcibly sent her to India. Therefore, based on her complaint a case has been registered against the proposed accused in Crime No.19 of 2016 for the offences punishable under Sections 406, 498(A) of IPC., and Section 4 of Dowry Prohibition Act on the file of the respondent police. After completion of investigation, the respondent police filed final report and the same was taken as C.C.No.524 of 2017 on the file of the learned Judicial Magistrate No.II, Dindigul. But the trial Court unnecessarily and periodically adjourned the case without assigning any valid reason and therefore, the present https://hcservices.ecourts.gov.in/hcservices/

petition has been filed before this Court for seeking a direction to expedite the trial and disposal of the case within a time frame.

4. Having been taken into consideration of the related facts and circumstances, this Court is of view that in the interest of Justice it may be expedient to issue a direction to the trial Court, as sought for by the petitioner.

5. In the light of the above, the learned Judicial Magistrate No.II, Dindigul, is hereby directed to dispose of the case in C.C.No.524 of 2017, as expeditiously as possible without loss of further time and without giving frequent adjournments.

6. With the above direction, this Criminal Original Petition is disposed of.
