Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing respondents 1 to 4 to cancel the dhana settlement in Document No.1932/2019 dated 15.4.2019 that the petitioner executed above dhana settlement Document to the fifth respondent and fifth respondent executed power of attorney in Document No.2502/2021 dated 23.04.2021 to the sixth respondent and sixth respondent executed the sale deed Document No.2605/2021 dated 28.04.2021 to the seventh respondent according to Section 23(1) of Tamil Nadu Maintenance of Parents and Welfare of Senior Citizen Act, 2007 and to take action against respondents 5 to 7 based on the representation dated 13.03.2024 to dispose of the same within the time limit that may be stipulated by this Court.

ORDER

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4. Considering the nature of relief to be granted, issuance of notice to the respondents 5 to 7 is dispensed with.

2.The petitioner moved the second respondent for cancelling the petition mentioned document.

3.The second respondent is directed to dispose of the same on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order. The interested parties including the private respondents herein will have to be necessarily heard before the final order is passed. I make it clear that I have not gone into the merits of the matter. It is for the second respondent to pass order one way or the other.

4.The writ petition is disposed of accordingly. There shall be no order as to costs.
