Respondent PRAYER: Writ Petition under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the respondent to sanction the subsistence allowance for the petitioner from the month of October 2020 and the arrears accrued thereon till the date and continue to issue the subsistence allowance in the forthcoming months without stoppage, by considering the representation of the petitioner dated 30.01.2021 and also to stipulate the respondent to fix a time frame.

ORDER

The learned Government Advocate made a submission that the order of suspension has already been revoked and the subsistence allowance has also been paid partly. However, the learned counsel for the petitioner made a submission that the petitioner has been reinstated into service.

2. This being the factum, the respondent, on revocation of suspension, must allow the petitioner to join duty and if any subsistence allowance due to the petitioner is also to be settled as expeditiously as possible. The Joint Registrar of Cooperative Societies/common cadre authority is directed to initiate steps to https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.9086 of 2021 allow the petitioner to join duty and pay the balance subsistence allowance to be paid. Accordingly, the writ petition stands disposed of. No costs.
