ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the second respondent to issue patta in favour of petitioner in respect of plot comprised in Survey Number 938/13, measuring an extent of 1316.25 Sq.Ft (3 Cents) in Patta No.2752, Ayyalur Village, Vedasanthur Taluk, Dindigul District, by implementing the proceedings of the first respondent in Na.Ka.No.95/2021/A7, dated 23.09.2021.

Originally, the land belonged to one Mohammed Hanifa, who purchased the said property vide Sale Deed dated 11.12.1996, registered as Document No. 1656 of 1996 in Survey No. 938, measuring an extent of 3071.25 sq. ft. Thereafter, the said Mohammed Hanifa subdivided the property in Plot No. 16 into two plots, one on the eastern side measuring 1316.25 sq. ft., which was purchased by the petitioner and another on the western side measuring 1755 sq. ft., which was sold to one Vellaisamy, son of Muthukannu. The respondents have issued patta to the said Vellaisamy.

3. This Court, in W.P.(MD) No. 29580 of 2023, by order dated 13.12.2023, directed the first respondent to conduct an enquiry and consider the case on merits. Based on the said order, the second respondent / Tahsildar surveyed the 2/6

property but failed to issue patta. Thereafter, the petitioner issued a contempt notice. Pursuant to the same, the second respondent again acted but failed to issue patta. Hence, the present writ petition has been filed.

4. In view of the above, the second respondent is directed to survey the property after issuing notice to the petitioner and the rival parties in accordance with law. If the second respondent requires any police protection, the same shall be granted by the jurisdictional police. The second respondent is directed to complete the survey and issue patta on or before 18.06.2026. The official respondents shall adhere to the following Standard Operating Procedures: • The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 3/6

5. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed on or before 17.06.2026. The second respondent / Tahsildar shall not state the reason of election as this Court finds contempt in the act of the second respondent / Tahsildar.

6. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
