ORDER

[Order of the Court was made by A.D.JAGADISH CHANDIRA, J.] When the matter was taken up for hearing today, the learned Additional Government Pleader appearing for the respondent submitted that the order, dated 07.08.2024 had been passed on the basis of an undertaking given by the then President of Kalayarkovil. He further submitted that as the communication, dated 06.08.2024 it has been stated that the cement road could be laid within a period two to three months as per the resolution passed by the Panchayat and that, the Panchayat also possessed the financial ability to carry out the work. Later, during the survey conducted by the first respondent Block Development Officer, it was found that the place where the road was sought to be laid is a patta land standing in the name of one Saradha, wife of R.M.Natarajan as per the village accounts and thereby, the order of this Court could not be complied with.

2. With regard to the same, he has also produced a copy of the proceedings of the Tahsildar in e.f.m6/1522/2025, dated 11.07.2025. In the proceedings, it has been recorded that the order of this Court had been complied with but that the respondent was unable to find the place, where the 2/4

road is sought to be laid and as the land is a patta land they are unable to comply with the order. The respondent Panchayat is unable to lay the road since it is a patta land. We find that only on account of the same, the respondent is unable to comply with the order.
