ORDER
(Judgment of the Court was made by N.SATHISH KUMAR, J.) The prayer in this writ petition is to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the 1st respondent in Na.Ka.No.3912/2023/A5 dated 19.08.2025, quash the same as arbitrary and illegal and in consequence to direct the 1st respondent to take appropriate action against the 6th respondent and other erring officials on the recommendation of the 3rd 2/6
respondent, by his report in Na.Ka.No.170/MGNREGS/2023 dated 27.12.2023.

The petitioner had given some complaints regarding the alleged misappropriation of the fund of the Panchayat office of the 6th respondent Panchayat, against the 6th respondent before the Ombudsman on 07.10.2023. The said Ombudsman by proceedings dated 12.10.2023, for want of jurisdiction has forwarded the same to the first respondent / District Collector, for taking appropriate action. Since the 1st respondent has not taken any action, the petitioner filed W.P(MD)No.8512 of 2024 seeking a direction to take action on the basis of certain recommendations made by the 3rd respondent against the alleged irregularities committed by the 6th respondent. This Court directed the District Collector to consider the representation submitted by the petitioner dated 07.10.2023 as forwarded by the Ombudsman by his proceedings dated 12.10.2023 and decide the same on merits and in accordance with law. Pursuant to the same, the District Collector conducted enquiry and has also taken note of the report of the 2nd respondent herein and found that the allegation has not been established. 3/6
Once the enquiry has been conducted on the basis of the factual report submitted by the authority concerned, the petitioner once again cannot insist that his contention has to be accepted by the authorities. Hence, we do not find any merits in this writ petition. 3.
