This Writ Petition has been filed to direct the 1st respondent to consider the representation preferred by the petitioner for correcting the mistake committed by him in changing the FMB in Survey No.154/1B3A of Nakachi Group Ramanathapuram District, Without any information or notice to survey No.154/1B3A1 of Nakachi Group, Ramanathapuram District and for retaining the original in Survey No.154/1B3A dated 21.02.2026 within a stipulated period of time.
2. The learned counsel for the petitioner submitted that a dispute exists between the petitioner and the second respondent, in respect of which the petitioner had earlier filed a suit in O.S. No. 15 of 2021 on the file of the District Munsif Court, Rameshwaram, and the same was decreed in favour of the petitioner, wherein the second respondent was one of the defendants. Subsequently, the second respondent instituted another suit in O.S. No. 422 of 2/5
2023 on the file of the Sub Court, Ramanathapuram, in which the petitioner is arrayed as a defendant and has filed a written statement. While so, the first respondent changed the Field Measurement Book (FMB) relating to the petitioner's property in Survey No. 154/1B3A and changed the entry in favour of the second respondent without issuing any notice or prior intimation to the petitioner. It was only after such change that the second respondent attempted to fence the property by bringing fencing stones, upon which the petitioner came to know of the mistake committed by the first respondent.
3. Heard the learned Additional Government Pleader appearing for the 1st respondent.
4. Considering the facts and circumstances of the case, this Court directs the Tahsildar/1st respondent to restore the property to its original position as it stood in the name of the petitioner's father. The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order. However, the parties are at liberty to raise the above issue in the pending civil litigation.
