PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 3rd Respondent herein to survey and demarcate the boundaries of the Petitioner's lands in Survey Numbers 83/6A2, 83/6B1B, 83/6C1, 83/6F, 83/6G, 83/6H1, 83/611 and 83/6J1 situated in Aviyur Village, Kariyapatti Taluk, Virudhunagar District as per the Field Measurement Application No. 2026/0123/26/000527 dated 02.02.2026 filed by the Petitioner herein and if the situation so necessitates, obtain official protection during the process of surveying the petitioners lands.

This petition has been filed seeking to direct the 3rd Respondent herein to survey and demarcate the boundaries of the Petitioner's lands in Survey Numbers 83/6A2, 83/6B1B, 83/6C1, 83/6F, 83/6G, 83/6H1, 83/611 and 83/6J1 situated in Aviyur Village, Kariyapatti Taluk, Virudhunagar District as per the Field Measurement Application No. 2026/0123/26/000527 dated 02.02.2026 filed by the Petitioner herein and if the situation so necessitates, obtain official protection during the process of surveying the petitioner's lands. 2/7

2. The learned counsel for the petitioner submitted that Rajkumar Harichand, who is the power of attorney holder for the petitioner, has made certain claims regarding property ownership. It was stated that Survey Nos. 83/6A2, 83/6B1B, and 83/6C1, admeasuring a total extent of 60 cents, were purchased by the petitioner from one R. Ravi Sankar through a sale deed dated 02.02.2022, documented under Doc. No. 337 of 2022. After the purchase, the petitioner obtained patta in his name under Patta No. 3360. Further, Survey Nos. 83/6F, 83/6G, 83/6H1, 83/6I1, and 83/6J1, situated in Aviyur Village, Kariapatti Taluk, Virudhunagar, with a total extent of 811⁄2 cents, were purchased by S. Sangaralinga Pandian through a sale deed dated 01.02.2022 under Doc. No. 345 of 2022, and the patta for this land was issued in his name under Patta No. 3375.

Therefore, the petitioner asserts ownership of the property in Survey Nos. 83/6A2, 83/6B1B, 83/6C1, 83/6F, 83/6G, 83/6H1, 83/6I1, and 83/6J1, situated in Aviyur Village, Kariapatti Taluk, Virudhunagar District, totaling 1411⁄2 cents. Furthermore, the petitioner's power of attorney, to one Rajkumar Harichand, has sought to survey and demarcate the property in question.

The learned Special Government Pleader for the respondents submitted that according to the application dated 02.02.2026 (Application No. 2026/0123/26/000527), it has been registered and is currently in the queue. It will be surveyed when the petitioner's turn arises. Therefore, the statement is recorded.

Considering the facts and circumstances of the case, this Court directs the 3rd respondent to conduct the survey and demarcate the property with assistance of the 4th respondent after issuing notice to the petitioner as well as the rival claimants, if any. If necessary, seek police protection, the Jurisdictional police shall provide police protection to survey the land. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures:

a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
