ORDER

The petitioner has filed this application under Section 379 of BNSS (Section 340 of CrPC) to take action as against the respondents that they have filed CrlOP(MD)No.11812 of 2025, seeking to quash the complaint of the petitioner lodged as against the respondents, by informing this court that the trial court has taken cognizance of the complaint of the petitioner.

2.Mr.S.Ramasamy, learned counsel appearing for the petitioner submits that the trial court has not taken cognizance of the complaint filed by the petitioner and only notice was ordered on the private complaint filed by the petitioner under Section 223 of BNSS calling for the explanation of the respondents. However they have filed the quash petition, as if the trial court has taken cognizance of the complaint and therefore, necessary action has to be taken as against the respondents. According to the learned counsel, this court has also granted an order of interim stay in the quash petition based on the submission made on behalf of the respondents / quash petitioners. 2/5

3.The learned counsel for the respondents / quash petitioners submits that this court has granted interim stay after perusing the complaint filed by the petitioner before the learned Judicial Magistrate. The petitioner has filed a petition to vacate the interim stay, however, he did not get it numbered and now he has moved this application in order to harass the respondents.

4.Heard the learned counsel on either side.

5.This Court has entertained the quash petition after perusing the complaint and the nature of the complaint and granted an interim order. Therefore, this court is not inclined to entertain this application filed by the petitioner. Accordingly, this petition is dismissed. Post CrlOP(MD)No.11812 of 2025 after four weeks for final disposal.
