O R D E R

This Writ Petition has been filed to call for the records relating to the unilateral rejection of online subdivision of patta application by the 2nd respondent dated 14.08.2024 and consequently for a direction directing the respondent No.2 to effect sub division of patta in the name of the petitioner for the lands in Survey No.6/11A Thiruparankundram Taluk, Madurai District within time stipulated by this Court.

The learned counsel appearing for the petitioner submitted that the petitioner had purchased house site properties in Survey No. 6/11, Thiruparankundram Taluk, Madurai District, by way of a registered sale deed in Document No. 2489 of 2010 dated 22.03.2010, to an extent of 10 cents, and by a settlement deed in Document No. 994 of 2012 dated 01.02.2012, to an extent of 51⁄2 cents. Further, the petitioner, along with another individual, namely Maayan, 2/5

had also purchased lands to an extent of 521⁄2 cents out of the total extent of 75 cents. After such purchase, the petitioner has been in possession and enjoyment of the property. Due to financial constraints, the petitioner intended to avail a loan by mortgaging the aforesaid property with a private bank. In this regard, the bank required the petitioner to produce a patta in his favour after sub-division of the said lands. Accordingly, the petitioner submitted an application to the second respondent seeking sub-division and transfer of patta in his favour and also paid the requisite fee. However, the second respondent rejected the same by the impugned order dated 14.08.2024.

3. Heard the learned Special Government Pleader appearing for the respondents.

4. The rejection order, upon perusal, is found to be a one-line, nonspeaking order. Accordingly, the impugned order is quashed. This Court directs the respondents to reconsider the application and pass a reasoned and speaking order in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.
