PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the 4th Respondent to consider the petitioner's representation dated 16.02.2026 and to rectify the patta and revenue records relating to the petitioner's property comprised in Survey Nos. 1/7, 4/5, 5/3, 7/1F, 7/2F, 2/9 and 3/1, situated at Pramanankulam Village, Kadaladi Taluk, Ramanathapuram District, and in Survey Nos. 193/1, 157/3A, 167/10B, 122/6A, 156/7, 157/2, 337/2, 149/6B, 150/1A, 149/6B1, 149/6B3 and 122/3B, situated at Melakkidaram Village, Kadaladi Taluk, Ramanathapuram District, and consequently to restore the same in the name of the petitioner, within the time stipulated by this Court.

This Writ Petition has been filed to direct the 4th Respondent to consider the petitioner's representation dated 16.02.2026 and to rectify the patta and revenue records relating to the petitioner's property comprised in Survey Nos. 1/7, 4/5, 5/3, 7/1F, 7/2F, 2/9 and 3/1, situated at Pramanankulam Village, Kadaladi Taluk, Ramanathapuram District, and in Survey Nos. 193/1, 157/3A, 167/10B, 122/6A, 156/7, 157/2, 337/2, 149/6B, 150/1A, 149/6B1, 149/6B3 and 2/6

122/3B, situated at Melakkidaram Village, Kadaladi Taluk, Ramanathapuram District, and consequently to restore the same in the name of the petitioner, within the time stipulated by this Court.

2. The learned counsel for the petitioner submitted that the land originally belonged to one Arumuga Thevar. Arumuga Thevar had two wives and four sons: Villiyappa Thevar from the first wife, and Ramu Thevar, Muniyandi Thevar, and Kannusamy Thevar from the second wife. After Arumuga Thevar's demise, Ramu Thevar and Villiyappa Thevar came into possession of the property. However, due to an error in the revenue records, the petitioner seeks to rectify the same. Further,the Veluchamy Thevar, the son of Villiyappa Thevar, had filed a suit in O.S. No. 13 of 1991 against Villayutha Thevar. After contesting, the suit was dismissed. An appeal, A.S. No. 939 of 1994, was subsequently filed, but it was also dismissed on 12.02.2007. More than 13 years later, the legal heirs of Ramu Thevar, along with 9 others, filed CMP(MD) No. 5362 of 2023 in A.S. No. 939 of 1994 before this Court, seeking to set aside the ex-parte order dated 12.02.2007. However, this petition was dismissed on 03.07.2025. Consequently, the dispute between Villayutha Thevar and Ramu 3/6

Thevar ended in favor of Villayutha Thevar, making the petitioner entitled to the property and eligible to seek patta.

3. Heard the learned Special Government pleader appearing for the respondents.

4. Considering the facts, the patta and the transfer of title to Arumuga Thevar are found to be improper. Accordingly, the respondents are directed to rectify the issue as per the judgment and decree in the suit. Further, the respondents are directed to issue the patta in favor of the legal heirs of Villayutha Thevar.
