Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st and 2nd respondents to survey the petitioner's property in T.S.No.245/1AP to an extend of 2.75 cents respectively situated at Block 0005, Ward: ap Santhanur North Town, Tiruchirappalli Corporation -Ariyamanagalam Zone, Trichy East Taluk, Trichy District and to fix its boundaries as per revenue records by 1/4

ORDER

With the consent of the learned counsel appearing on either side, the writ petition is taken up for final disposal, even at the stage of admission.

2. The petitioner has sought for survey and in this connection, he has made an application on 30.12.2024. The petitioner has also stated that as the petitioner is not in good terms with the neighbour, police protection would also be required.

3. The learned Government Advocate appearing for the respondents 1 & 2 would submit that the petitioner has made payment to the Tiruchirappalli City Municipal Corporation for survey and not to the survey authorities as required under the Act. 2/4

4. However, I find that the representation has been given only to the Tahsildar, Trichirappalli Taluk dated 21.02.2025. In view of the above, the petitioner shall remit the necessary fees to the Revenue authorities by online mode and there upon, the first respondent along with the second respondent shall pass orders on the petitioner's application dated 21.02.2025 within a period of twelve weeks from the date of payment of the requisite fee. In the event of the first respondent apprehending any law and order problem at the time of survey, the first respondent shall seek the assistance of the third respondent, who shall ensure that sufficient police personnel are posted at the site to prevent any breach of peace at the time of survey.

5. With the above directions, the writ petition is disposed of. No costs.
