COMMON PRAYER: Civil Revision Petitions are filed under Article 227 of Constitution of India, to direct the District Munsif Court (Rent Authority), Paramakudi to receive the un-numbered petitions in HRCOP.Nos...... of 2019 and number the same.

Narendravasan For R1, R4 to R6 in all CRPs : Mr. D.Senthil C O M M O N O R D E R These Revision petitions are directed against the orders returning the Rent Control Original Petitions in unnumbered HRCOP.Nos. .... of 2019 on the file of Rent Controller / District Munsif Court, Paramakudi, directing the petitioners to file before the appropriate forum.

2. The learned counsel for the petitioners would submit that they came to know that the Collector, who is the appointing authority, has issued the proceedings appointing the Rent Authority under Section 30 of the Tamil Nadu Regulation of Rights and https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P. (MD).Nos. 557 to 562 of 2020 Responsibilities of Landlords and Tenants Act, 2017 and therefore, the petitioners have to approach the said authority only.

3. Section 30 of the said Act contemplates that the Collector, shall with the previous approval of the Government, appoint an officer, not below the rank of Deputy Collector to be the Rent Authority for the area within his jurisdiction to which this Act applies.

4. It is evident from the proceedings of the District Collector, Ramanthapuram in ROC.G4/15480/2018, dated 27.05.2019, he has appointed the Revenue Divisional Officer, Paramakudi as Rent authority for the Paramakudi Sub Division in exercise of power under Section 30 of the said Act.

5. As rightly contended by the learned counsel for the petitioners, for depositing the rent, the tenant has to approach the Rent authority and as such the return made by the District Munsif cannot be found fault with. Hence, these revisions are disposed of with liberty to approach the Rent Authority. No costs.

6. Registry is directed to return the original petitions filed along with the revision petitions, after substituting the xerox copy of the same.
