Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondent herein to consider petitioner's representation dated 07.04.2022 to notify in the Tamilnadu Gazette publication for petitioner name as A.Nithishvar C/o.Amaravathi residing at D.No.1/220, A.B. Nagar, Ponnagaram, Natham Road, Dindigul Town, Dindigul East Taluk, Dindigul District, within stipulated time as fixed by this Court.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the respondent to consider the petitioner's representation dated 07.04.2022 to notify in the Tamil Nadu Gazette publication for the petitioner's name as A.Nithishvar, C/o.V.Amaravathi, residing in Door No.1/220, A.B. Nagar, Ponnagaram, Natham Road, Dindigul Town, Dindigul East Taluk, Dindigul District within a time frame to be fixed by this Court.

2. According to the petitioner, his father, Sritharan, has deserted him and his mother as well as his sister in the year 2017 and they have been living separately for the past five years. In order to remove the name of the father from his educational records, he has given a representation on 07.04.2022 with the respondent requesting them to notify his name as A.Nithishvar, C/o.V.Amaravathi instead of A.Nithishvar, C/o.Sritharan. The petitioner has already changed his name in his Aadhaar card which is also enclosed along with this Writ Petition.

3. Heard Mr.S.Sarvagan Prabhu, learned counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader, who accepts notice on behalf of the respondent.

4. No prejudice would be caused to the respondent, if the petitioner's representation, as stated supra, is considered on merits and in accordance with law, after affording a fair hearing to the petitioner within a time frame to be fixed by this Court.

5. For the foregoing reasons, this Court directs the respondent to consider the petitioner's representation dated 07.04.2022 seeking to notify his name in the Tamil Nadu gazette publication as A.Nithishvar, C/o.V.Amaravathi, residing at Door No.1/220, A.B. Nagar, Ponnagaram, Natham Road, Dindigul Town, Dindigul East Taluk, Dindigul District instead of A.Nithishvar, C/o.Sritharan and pass final orders on merits and in accordance with law, after affording a fair hearing to the petitioner, within a period of four (4) months from the date of receipt of a copy of this order.

6. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
