Prayer: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ in the nature of Mandamus, directing the 2nd respondent to disburse the arrears of monetary benefits by fixing the notional pay from 01.07.2000 from the cadre of Tahsildar under the 2nd respondent District Revenue Subordinate Service to the petitioner. O R D E R
The petitioner has come forward with this writ petition, seeking a direction to the 2nd respondent to disburse the arrears of monetary benefits by fixing the notional pay from 01.07.2000 from the cadre of Tahsildar under the 2nd respondent District Revenue Subordinate Service to the petitioner.
2. Learned counsel for the petitioner would make a plea that if the representations of the petitioner forwarded to the second respondent on various dates starting from 06.06.2011 are disposed of, the grievance of the petitioner would be redressed.
3. Having regard to the facts and circumstances of the case, the second respondent, without adverting into the merits of the case, is directed to consider the representations of the petitioner dated 06.06.2011 followed by several reminders on merits and in accordance with law and after affording an opportunity of hearing to him, pass appropriate orders within a period of two months from the date of receipt of a copy of this order. If on a specified date the petitioner does not appear for personal hearing, suitable orders may be passed on merits based on the available records after recording the absence of the petitioner.
With the above direction, this writ petition is disposed of. No costs.
