Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of certiorarified mandamus calling for the records relating to the impugned order issued by the respondent, in his proceedings Nil dated 18.09.2014 and quash the same and consequently directing the respondent herein to sanction and disburse the educational loan for a sum of Rs.2,79,000/- (Rupees two lakhs seventy nine thousand only) for B.E degree course (Mechatronics) of petitioner's son viz. Benish, for the academic year 2013 to 2017 without insisting to secure minimum marks of 60% as eligibility criteria and pass suitable or other orders as this Court may deem fit and proper in the circumstances of the case.

O R D E R

In this writ petition the petitioner is seeking for issuance of a Certiorarified Mandamus calling for the records relating to the impugned order issued by the respondent, in his proceedings Nil dated 18.09.2014 and quash the same and consequently directing the respondent herein to sanction and disburse the educational loan for a sum of Rs.2,79,000/- (Rupees two lakhs seventy nine thousand only) for B.E degree course (Mechatronics) of petitioner's son viz. Benish, for the academic year 2013 to 2017 without insisting to secure minimum marks of 60% as eligibility criteria.

2. Heard the learned Counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. Today when the matter is taken up for hearing, the learned counsel for the petitioner submitted that the petitioner has now produced a document showing his participation in the counselling which entitles him to get sanction of loan. He would further submits that if the petitioner got below 60% of marks, he could not have participated in the counselling and therefore, he prays that the respondent may be directed to sanction educational loan.

Considering the above submission, the impugned order passed by the respondent on 18.09.2014 is set aside and the respondent is directed to sanction and disburse educational loan in the light of the new document produced by the petitioner within a period of three weeks from the date of receipt of copy of this order.

5. With the above direction, this writ petition is disposed of. No costs.
