ORDER
The present Writ Petition has been filed to quash the impugned check slip issued by the respondent in RFL/Ilaiyangudi/9/2024, dated 15.02.2024 and consequently, to direct the respondent to register the Settlement Deed executed by the Petitioner and represented before the respondent on 15.02.2024, as per the order made in WP(MD).No.29948 of 2023, dated 15.12.2023. The second respondent impleaded by this Court, who had filed an objection before the authority not to register the petitioner's settlement deed . 2.The contention of the second respondent is that when the original owner of the property has sold the property to the second respondent, the original owner's legal heirs had also sold the property to the petitioner, which is subsequent. Therefore, he has filed an objection. 3.After elaborate arguments made on either side, this Court is of the considered opinion that the second respondent objection cannot be considered at this stage because already the sale deed is registered in the petitioner's name. 2/4
Now, he is intended to settle the property in the name of his grandson. The second respondent is claiming the title dispute, which cannot be decided by the first respondent. Therefore, the impugned order is liable to be quashed. 4.Accordingly, this writ petition stands allowed. The impugned check slip issued by the respondent in RFL/Ilaiyangudi/9/2024, dated 15.02.2024, is hereby quashed. The first respondent is directed to register the settlement deed executed by the petitioner. The petitioner as well as the second respondent are at liberty to file a suit before the civil Court to determine their titles. There shall be no order as to costs.
