ORDER : The Court Made the following order :- The petitioner is arrayed as sole Accused. He was arrested and remanded to judicial custody on 11.05.2018 for the offences punishable under Sections 392, 397 and 506(ii) of I.P.C., in Crime No. 481 of 2018, on the file of the respondent police. He seeks bail.

2.The learned counsel appearing for the petitioner submitted that the petitioner did have a questionable pass. But then, he has been regularly attending the trial in the old case. On a particular date, due to Boycott of Advocates, he could not file application under Section 317 of Cr.P.C. Hence, Non Bailable Warrant came to be issued. He was taking steps to file recall the warrant. The same was recalled when the present false case was put up. 3.The learned Government Advocate (Crl. Side), strongly opposed the granting of bail stating the bad antecedents of the petitioner. 4.This Court went through the contents of the First Information Report, they did not inspire the confidence of the Court. 5.Taking note of the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail, subject to the following conditions;

(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Dindigul.

(ii)the petitioner is directed to appear before the respondent police as and when required for interrogation. (iii)on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
