Respondents Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus to direct the respondents 1 to 3 to take necessary action against the 4th respondent for having illegally collected special fees from the students in standards 6th to 12th in contravention of the circular issued by the 1st respondent in Na.Ka.No.50104/G2/E3/2012 dated 18.10.2013 and consequently issue necessary direction for refunding of such fees so illegally collected from the students. complaining that the school authorities are collecting excess fee from the students unauthorisedly. He seeks appropriate direction in this regard.

2. The learned Government Advocate would submit that on these allegations an enquiry was held by the District Educational officer, Trichy and on completing the enquiry, she submitted a report in Na.Ka.No.5386/Aa2/2015 dated 18.09.2015, wherein she has stated that there has been no such illegal collection of any excess fee from the students. The said statement is recorded. However, we are of the view that it is for the competent authority to ensure in future that there is no collection of any excess fee from the students illegally.
