Respondents Prayer :Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the proceedings pertaining to the Impugned order passed by the 1st Respondent vide proceedings in Mu.mu.No.2378229/2024/C6 dated 11.12.2025 and quash the same as illegal and 1/6
consequently, to remand back the appeal with a direction to the 1st Respondent to dispose the appeal within the time limit as stipulated by this Court by following the procedure as prescribed under The Maintenance and welfare of parents and senior citizens Act, 2007.

ORDER
The petitioner is before this Court challenging the order dated 11.12.2025 passed by this first respondent in Mu.mu.No.2378229/2024/C6.
2. By the said impugned order, the petition filed by the petitioner under Section 23 of the Maintenance and welfare of Parents and Senior Citizens Act, 2007, for cancellation of the settlement deed executed in favour the third 2/6
respondent came to be dismissed against which the petitioner filed an appeal under Section 16 of the Act before the first respondent.
3. The first respondent passed the impugned order dismissing the appeal stating that the petitioner had not furnished the correct address of the respondents 3 and 4 herein.
4. However, for reasons best known, notices were not served on the said respondents in the given address. Now the respondents 3 and 4 have entered appearance through counsel before this Court and submit that it would suffice if the impugned order is set aside and the application submitted by the petitioner for cancellation of the settlement deed executed in favour of the third respondent is restored.

5. Accordingly, the Writ petition is allowed and the order dated 11.02.2025 passed by the first respondent is hereby set aside.
6. There shall be no orders as to Costs. Consequently, connected miscellaneous petition is closed.
