ORDER

The writ petition is filed for a mandamus to direct the respondent to handover the petitioner's tractor bearing registration No.TN 65 BW 3915, which stands in the name of the petitioner's deceased father namely Thangamanikam by considering his representation dated 07.02.2026.

2. Heard Mr.B.Anandan, learned counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondent.

Upon hearing the learned counsel appearing for the petitioner and perusing the material records of the case, the case of the petitioner is that the tractor originally stood in the name of the petitioner's father, namely Thangamanikam, who died on 05.02.2025. It is stated that certain persons who were friendly with his father, attempted to usurp the said movable property by creating a fraudulent transfer, which was also recorded in the registration certificate. Consequently, when a complaint was made, the tractor was taken into the custody of the respondent and an enquiry was conducted. After the enquiry, it was found that the said 2/6

transaction was fraudulent, and the entries were cancelled; as of now, the registration stands in the name of the petitioner's father. Therefore, there is no impediment for the respondent in handing over the tractor to the petitioner. Hence, the writ petition is filed.

4. Per contra, the learned Special Government Pleader appearing on behalf of the respondent would submit that it is true that an enquiry was conducted and the entry was reversed. After the reversal, the tractor has to be handed over to the legal heirs of Thangamanikam. The petitioner is not the sole legal heir; there are other legal heirs as well. Therefore, all the legal heirs should jointly approach the respondent for handing over of the tractor.

5. In view of the above, as rightly contended by the learned Special Government Pleader for the respondent, the tractor must be handed over to all the legal heirs. Since the petitioner is only one of the legal heirs, he must either approach the respondent jointly with all the legal heirs or produce a notarized affidavit with a No Objection from the other legal heirs to facilitate the handing over of the tractor in his favor. 3/6

6. Upon production of the notarized affidavit, the tractor shall be handed over to the petitioner. The parties are directed to undertake the above course of action, with the web copy of the order without without waiting for the certified copy of the order.

7. The writ petition is disposed of with the above directions. No costs.
