ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 and 2 to survey and demarcate the land in Survey No.618/7 situated at Pallavarayanpaththai Revenue Village, Karambakkudi Taluk, Pudukkottai District, within stipulated time fixed by this Court.

2. The respondents 3 and 4 are neighbours of the petitioner. The petitioner claims right over the property in Survey Nos. 618/7 and 618/6A. However, Respondents 3 and 4 dispute the petitioner's right in Survey No. 618/6A, for which a suit in O.S.No.143 of 2025 has been filed on the file of the Sub Court, Pudukkottai, wherein the petitioner is the first defendant along with three others. The third respondent seeks declaration and injunction only in respect of Survey No. 618/6A. Even though Survey No. 618/7 is shown as the third item in the schedule of property, no relief has been sought in respect of the same. The petitioner has also filed a suit in O.S.No.14 of 2025 on the file of the District Munsif Court, Karambakkudi, wherein the schedule property is shown as Survey No. 618/6 alone.

3. Therefore, it is clear that there is a dispute between the petitioner and 2/5

Respondents 3 and 4 only with regard to Survey Nos.618/6 and 618/6A, and not Survey No.618/7. Hence, the first respondent is directed to survey and demarcate the land in Survey No.618/7 with the assistance of the second respondent, after issuing notice to the petitioner as well as Respondents 3 and 4. In case the first respondent requires police protection, the same may be granted by the jurisdictional police. The official respondents shall adhere to the following Standard Operating Procedures:

• The official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. • After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

• If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. The aforesaid procedure shall be strictly followed by the parties. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a 3/5

copy of this order.

4. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
