ORDER
The present writ petition has been filed for the following relief:- "Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorari calling for the records relating to the impugned dismissal order in EPFA 69/2024 dated 29.08.2025 on the file of the Central Government Industrial Tribunal Cum Labour Court, Chennai and quash the same as illegal and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render justice"
2. Heard Mr.B.Prasanna Vinoth, learned counsel appearing for the petitioner and Mr.A.Sivasubramanian, learned Standing Counsel, who takes notice on behalf of the respondent.
3. The learned counsel appearing for the petitioner would submit that by an order dated 11.07.2024, while admitting the appeal, a condition was imposed for the grant of stay, directing the appellant to deposit a sum of Rs.10,00,000/-.

4. According to the learned counsel for the petitioner, even if the said amount had not been deposited, the appeal itself could not have been dismissed. In any event, he submitted that the petitioner is now willing to deposit the said sum of Rs.10,00,000/-, if a further period of four weeks is granted.
5. The learned Standing Counsel appearing on behalf of the respondent would submit that since the conditional order was not complied with, the appeal was rightly disposed of.
6. There is some merit in the submission made by the learned counsel for the petitioner. A perusal of the conditional order shows that the condition imposed was only with reference to the grant of stay. The petitioner had been directed to deposit a sum of Rs.10,00,000/-. The petitioner now undertakes to comply with the said condition.
7. In view thereof, the writ petition is allowed on the following terms:- 3/6
i. The petitioner is directed to deposit a sum of Rs.10,00,000/- with the respondent on or before 3rd April 2026;
ii. Upon such deposit, the impugned order dated 29.08.2025 shall stand set aside and EPF A No.69/2024 dated 11.07.2024 stand restored to the file of the Tribunal;
iii. It is needless to mention that, if the aforesaid amount is not deposited within the time stipulated, the writ petition stands automatically dismissed and the order dated 29.08.2025 shall stand confirmed.
iv. No costs. Consequently, connected miscellaneous petition is closed.
