PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to take action for removing the patta entry made by respondents 4 and 5 in Patta No.3455, 3424, 3425 in S.Nos.197/12A2, 12A1B, 12A1C and 12A3 at Keeramangalam North, Alangudi Region, Puthukottai District by considering the representation set to the respondents 1 and 2, dated 24.2.2024. Advocate For Respondents : Mr.T.Leninkumar O R D E R The Writ Petition is filed seeking a direction to the first respondent to take necessary action to remove the entry made in favour of respondents 4 and 5 in the revenue records in Patta No. 3455, 3424, 3425 in respect of property in S.Nos.197/12A2, 12A1B, 12A1C and 12A3 at Keeramangalam North, Alangudi Region, Puthukottai District by considering the representation to the respondents 1 and 2, dated 24.2.2024.
2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, 1 acre 22 cents of land in 2/6
S.No.197/2A originally belong to the Petitioner's grand-father Nagoor Kani Ravuthar. According to the Petitioner, he died on 15.4.1975 and after his death registered sale deed, dated 24.12.1976 was created as if the Petitioner sold the property to one Vishwanathan who happens to be the vendor of the respondents 4 and 5. Since the respondents 4 and 5 obtained revenue documents in their name based on the registered sale deed, dated 24.12.1976 questioning the said document, the instant representation has been filed by the Petitioner seeking cancellation of the patta issued in the name of respondents 4 and 5. The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ petition for the relief stated supra. 4.
The Petitioner seeks cancellation of revenue entry in favour of respondents 4 and 5 mainly on the ground that the sale deed in favour of vendor of respondents 4 and 5 was invalid and a bogus document. The revenue officials are not entitled to decide the validity or otherwise of the registered document and it is for the Petitioner to move the competent Civil Court to decide that question.Therefore, this Court is not inclined to entertain the present Writ Petition.
5.Accordingly, the Writ Petition stands dismissed, with 3/6
liberty to the Petitioner to approach the competent Civil Court seeking redressal of his grievance, in the manner known to law. No costs. Consequently, connected Miscellaneous Petition is closed.
