O R D E R

This Writ Petition has been filed to direct the 3rd Respondent to consider the petitioner's representations dated 17.08.2025, 13.10.2025 consequently issue Patta in favour of the Petitioner and her mother in respect of the petition mentioned property based on the Settlement Deed executed in favour of the Petitioner's father vide Document No.7205 of 2007 dated 21.09.2007, within a time frame as may be stipulated by this Honble Court.

The learned counsel appearing for the petitioner submitted that the petitioner claims rightful ownership of the subject property by virtue of a settlement deed executed in favour of the petitioner's father, vide Document No. 7205 of 2007. The brief facts of the case are that the petitioner's grandparents, namely Ammumuthu Chettiar and Kaliyammal, owned a house site property 2/6

situated at Alampatti Revenue Village, Kovilpatti Taluk, Thoothukudi District, in Survey No. 135/1B17. After purchasing the said land, they constructed a residential house bearing Door Nos. 5/182B, 5/182C, and 5/182D. The petitioner's grandparents had three sons and two daughters, among whom the petitioner's father, Ramasamy, is one of the legal heirs. After the demise of the grandfather, the petitioner's grandmother executed separate settlement deeds in favour of all her children. One such settlement deed was executed on 21.09.2007 in favour of the petitioner's father. Thereafter, the petitioner's father was in possession and enjoyment of the property, and the patta also stood in his name under Patta No. 829.

3. Subsequently, the petitioner's father died on 24.10.2013. After his demise, the petitioner's mother executed a settlement deed in favour of the petitioner. However, as the patta had not been transferred, the petitioner submitted a representation along with the settlement deed and legal heir certificate, and also made an online application seeking transfer of patta to his name. Despite submitting a detailed representation and paying the requisite fee, the respondents 3/6

have failed to consider the same. Hence, the petitioner has filed the present writ petition.

The learned Additional Government Pleader appearing for the respondents submitted that the land in question is described as Survey No. 135/1 in the settlement deed, whereas the petitioner claims rights over property in Survey No. 135/1B17, thereby indicating a discrepancy in the survey numbers. This submission is recorded."

Considering the facts and circumstances of the case, this Court directs the second respondent to conduct an enquiry after issuing notice to the petitioner as well as the rival claimants if any and pass appropriate orders within a period of 12 weeks from the date of receipt of a copy of this order. The personal hearing may be granted to the parties.
