ORDER

The present petition has been filed by the sole accused in C.C. No.164 of 2023 on the file of the learned Judicial Magistrate No.I, Karur, Karur District, seeking to quash the chargesheet wherein he has been charged with the offences under Sections 294(b), 353 and 506(i) of IPC.

2. A perusal of the chargesheet reveals that the petitioner went to the ladies' ward in the Government Medical College Hospital, Karur, on 17.02.2023 at about 10:00 a.m and he is alleged to have videographed the said ward. When he was confronted by the hospital staff, he is alleged to have abused them and prevented them from doing their duty.

According to the learned counsel appearing for the petitioner, he had one of his relatives admitted to the said ward on 13.02.2023, and he lodged a complaint about the unhygienic food and the insanitary conditions of the hospital before the District Collector on 13.02.2023, and therefore, a false complaint has been lodged as against him.

4. Per contra, the learned counsel appearing for the first respondent submitted that the petitioner has taken a videograph of the other lady patients in the ward, and therefore, the said charge sheet has been laid.

5. Heard the learned counsel appearing for the petitioner as well as the learned counsel appearing for the first respondent.

6. A perusal of the charge sheet reveals that the mobile phone of the petitioner has been seized. Unless the videograph recorded in the mobile phone is perused, it could not be found out whether the allegations of the petitioner is true or whether he had videographed the other lady patients.

7. In the said circumstances, this Court cannot consider the dispute at this point in time for the purpose of quashing the chargesheet.

8. Considering the fact that the chargesheet has been laid in the year 2023 and so far, none of the witnesses have been examined, the trial court is directed to dispose of the case in C.C. No.164 of 2023 on the file of the learned Judicial Magistrate No.I, Karur, Karur District, on or before 31.07.2026 and the respondent police officials are directed to co-operate for the same. 3/5
