Prayer:This petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to issue a direction to entrust the investigation in Crime No.47 of 2025 dated 06.10.2025 pending on the file of the 5th respondent to the 4th respondent and to conduct the investigation under strict supervision under the control of the 2nd respondent. ORDER

The present petition has been filed by the defacto complainant in Crime No.47 of 2025 on the file of the 5th respondent police seeking to transfer the investigation to the file of the 4th respondent for conducting proper investigation.

2.A perusal of the F.I.R reveals that the petitioner herein is the victim of Cyber Crime and he has lost more than Rs.76,00,000/-. According to the petitioner, many other persons have also lost money in the Cyber Crime. He further submits that the accused persons are located in different State. In such circumstances, according to him, the Station House Officer of the 5th respondent would find it difficult to continue with the investigation process. Therefore, he seeks transfer.

3.The learned Government Advocate (Crl.side) appearing for the 5th respondent had raised strong objection for transferring the investigation from 2/5

the 5th respondent to the 4th respondent and submitted that huge sum of money has already been recovered from the accused persons and there is no necessity for transferring the investigation from the 5th respondent to the 4th respondent.

4.Heard the learned counsel appearing on either side and perused material records.

5.The only grievance of the petitioner is that for administrative convenience and for proper interaction with the police officials of the other States, he seeks transfer of investigation from the 5th respondent to the 4th respondent. He had also submitted that he is not making any allegation as against the 5th respondent police.

6.Considering the above said facts, the investigation in Crime No.47 of 2025 on the file of the 5th respondent is hereby transferred to the file of the 4th respondent. It is made clear that this Court has not made any adverse remarks as against the 5th respondent herein and only for administrative convenience and for the effective investigation, it is being transferred to the 4th respondent. The 4th respondent is directed to complete the investigation within a period of four months from the date of receipt of a copy of this order. 7.With the above said observation, this Criminal Original Petition stands disposed of.
