W.A.(MD) No.765 of 2025 has been filed challenging the order of the learned Single Judge passed in W.P.(MD) No.18982 of 2022, dated 21.01.2025, whereby the registering authority was directed to receive and register the document presented for registration. 7/14
2.The said Writ Petition was filed by the respondents 1 to 3/writ petitioners contending that the subject properties were originally covered under a layout approved by the Deputy Director of Town and Country Planning (DDTCP) vide Layout Approval No.33 of 1985 in proceedings Na.Ka.No.108 of 1985. Pursuant thereto, 357 plots were formed. As per the approved layout, certain portions were earmarked as Open Space Reservation (OSR) areas, such as roads, parks, children's play areas, etc. Similarly, in the very same layout, an extent of 4,75,498 sq.ft. was earmarked for industrial purposes, such as small-scale industries, cottage industries, trade-related activities and a petrol bunk. 3.
Since the said area could not be developed for the purpose for which it had been reserved, the promoters approached the authorities in the year 2009 seeking permission to form a layout in the saleable area. The proposal was approved by the Panchayat through a resolution and was thereafter forwarded to the DDTCP authorities for approval. Proceedings were issued on 25.01.2018 and 17.07.2018.
orders were passed by the competent authorities and the plots were regularised. When the owners sought to alienate the plots and presented documents before the Sub-Registrar for registration, the same were refused. Under such circumstances, the Writ Petition came to be filed. 4.The learned Single Judge, taking into consideration the fact that the saleable area had been converted into plots and that the necessary approvals had been granted, directed the registering authority to register the documents while disposing of the Writ Petition. The learned Single Judge also specifically recorded that the areas earmarked for common purposes, namely roads, parks, playgrounds, etc., being non-saleable areas, could never be subject to alienation.
5.We have heard the learned counsel appearing on either side and perused the materials available on record. 9/14
6.The learned counsel appearing for the appellant would mainly contend that the roads earmarked for public use, which had vested with the Panchayat, were also plotted out and that encroachments had been made thereon.
7.We directed the appellant to point out the nature of the alleged encroachment and to produce supporting documents. However, except for producing the original approved layout plan and an unauthenticated sketch, no document has been placed before us to substantiate the allegation. 8.The main grievance of the appellant is that the areas earmarked as roads have been encroached upon.
9.In view of the above, we find that the learned Single Judge has already made it clear that the portions originally earmarked in the approved layout for road purposes cannot be alienated. We are also of the view that it 10/14
is for the local body authorities to verify whether any encroachment exists in the areas earmarked for public purposes and, if any such encroachment is found, the same shall be removed in accordance with law. 10.Insofar as the regularisation of the plots is concerned, the regularisation has been granted only in respect of the available saleable area. Once the plots have been duly regularised by the competent authority, there cannot be any justification for refusing registration of documents relating thereto. We, therefore, find no infirmity in the order passed by the learned Single Judge. Accordingly, W.A.(MD) No.765 of 2025 stands dismissed. 11.In view of the order passed in W.A.(MD) No.765 of 2025, W.P.(MD) No.8447 of 2019 is disposed of, as we have already directed the local body authorities to remove any encroachment found in the areas earmarked for public purposes, such as roads, parks, etc. 11/14
12.In view of the order passed in W.A.(MD) No.765 of 2025, the impugned order dated 12.04.2025 passed by the Sub-Registrar, which is under challenge in W.P.(MD)No.14994 of 2026, is hereby quashed. Consequently, W.P.(MD)No.14994 of 2026 is allowed and the Sub-Registrar is directed to register the document, if it is otherwise in order, within a period of fifteen (15) days from the date of its presentation. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
