Complainant Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records in C.C.No.130 of 2018 on the file of the learned Judicial Magistrate No.II, Sivagangai and quash the same as against this petitioner herein. ORDER

This petition has been filed seeking to quash the proceedings in C.C.No.130 of 2018 on the file of the learned Judicial Magistrate No.II, Sivagangai

2. When the matter is taken up for hearing, the learned counsel appearing for the petitioner would submit that the petitioner restricts the prayer only with regard to dispense with the personal appearance of the petitioner before the trial Court and to direct the learned Judicial Magistrate No.II, Sivagangai, to expedite the trial and complete the same within a time to be stipulated by this Court.

3. In view of the above, the learned Judicial Magistrate No.II, Sivagangai, is directed to expedite the trial and complete the trial process in C.C.No.130 of 2018 within a period of five months https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.1783 of 2019 from the date of receipt of a copy of this order.

4. The personal appearance of the petitioner is dispensed with before the trial Court with the following conditions:- (i) the petitioner shall appear before the trial Court, within 15 days from the date of receipt of a copy of this order and she shall file an undertaking affidavit that she will appear before the concerned Court as and when required, she must ensure that she is properly represented by an Advocate.

5. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected Criminal Miscellaneous Petitions are closed.
