O R D E R

Today, when the matter is called, the petitioners namely, Yesu Padham and Bellish Raj and the defacto complainant, Ramachandran, are present. Learned Government Advocate (Criminal Side) submitted that investigation in Crime No.503 of 2015 has been completed and final report has also been filed in PRC No.30 of 2015 before the learned Judicial Magistrate No.III, Nagercoil. Learned counsel for the petitioners submits that the second petitioner, Bellish Raj, is going to abroad and therefore his presence may be dispensed with in the future hearing. The identity of Bellish Raj, 2nd petitioner, is confirmed by the Government Advocate (Criminal Side) through the respondent Police, namely K.Shobanaraj, the Sub Inspector of Police, Suseendram Police Station, Kanyakumari District.

The 2nd petitioner, Bellish Raj, need not be present, when the final report is challenged. It would suffice, if the 1st petitioner and the defacto complainant are present, when the final report is challenged. Recording the submissions of the learned Government Advocate, this criminal original petition is closed with liberty to the petitioners to challenge the final report in the manner known to law.
