ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the first respondent to consider the petitioner's representation dated 05.02.2026 and to expedite the enquiry proceedings and to pass orders within a time stipulated by this Court.

The land in Survey No.1180A/1 to an extent of 3 acres 4 cents originally belonged to one M.Valasubramanian and one M.Muthukaruppa Thever vide patta No.332 and their names were entered in the village resettlement register of the year 1911. After the demise of the said M.Valasubramanian, his son Subbaiah Devar inherited the property to an extent of 1 acre and the said property had been given to Tamil Nadu Boothan Board.

(i) The rest of the land has been subdivided as Survey No.118A/1B, to an extent of 0.40.5 hectares vide Patta No.1763 in the name of Tamil Nadu Boothan Board. As far as the remaining 52 cents are concerned, the said Subbaiah Thevar had executed a registered sale deed on 16.05.1966 in favour of Siluvai Fernando and Antonysamy Fernando, vide Document No.1112 of 1966. Then the said Siluvai Fernando and Antonysamy Fernando executed a sale deed in favour of Mahalinga Thevar on 13.11.2008, vide Document No.3178 of 2008. The extent of 2/6

1 acre and 52 cents belonging to Muthukaruppa Thevar was enjoyed by his legal heirs, namely Shanmugasundara Thevar, Muthaiah Thevar, and Valasubramanian. On 16.05.1968, the said Muthaiah Thevar had executed a sale deed in favour of Mahalinga Thevar in respect of 1/3rd share to an extent of 51 cents wide Document No.1318 of 1968. Similarly, the legal heir of Shanmugasundara Thevar, namely, Muthupandi executed a sale deed in favour of the petitioner on 10.03.2008 vide Document No.709 of 2008.

(ii) The remaining 1/3rd share of Muthukaruppa Thevar, to an extent of 50 cents, was enjoyed by the said Valasubramanian. After his demise, his daughter Muthulakshmi and her husband, Mahalinga Thevar, son of Vellathurai, were in possession and enjoyment of the same. The property purchased by one Mahalingam through Document No.1318 of 1968 to an extent of 51 cents was enjoyed by the legal highs of Mahalinga Thevar, namely Madasamay Thevar, Maruthaiah Pandian and Vellathurai for 17 cents each. The said Vellathurai executed a registered sale deed dated 10.03.2008 in favour of the petitioner to an extent of 17 cents and also 50 cents which was inherited through the father in law's land vide Document No.708 of 2008.

(iii) The said Maruthaiah Thevar also executed a sale deed dated 29.09.2008 to an extent of his share of 17 cents in favour of the petitioner vide Document No.2825/2008. Futher, another son, namely Madasamy, had executed a sale deed in favour of the petitioner's son, namely, Manikandan in respect of his 3/6

share to an extent of 17 cents through inheritance and also sold 52 cents on 27.4.2011, vide Document No.1640/2011. The petitioner purchased the property to an extent of 1 acre 34 cents, vide Document Nos.708/2008, 709/2008 and 2825/200. Likewise, the petitioner's son, Manikandan, purchased the property to an extent of 17 cents, vide Document No.1640/2011. Subsequently, both the petitioner and his son also purchased a total extent of 2 acres 4 cents of land in Survey No.1180A/1 and they also obtained a joint patta bearing No.1681. However, in the said joint patta, the name of one Sudalaikannu Thevar, S/o.Muthaiah Thevar and Solomon, S/o.Koil Thevar, were included inadvertently. The said Solomon and Sudalaikannu Thevar, the respondents 2 & 4 are no way connected with the subject property.

(iv) The petitioner submitted that the petitioner and his son purchased the property only to an extent of 2 acres 4 cents in respect of Survey No.1180A/1. However, during the UDR proceedings, the name of the fourth respondent was mistakenly included and he is no way connected to the said property. Taking advantage of the wrong entry, the second respondent created a forged sale deed to an extent of 51 cents belongs to the second respondent, vide Document No.2802/2008. Thereafter on 24.09.2019, another forged sale deed was executed by the said Solomon in favour of one Mahalingam, the third respondent herein, vide Document No.1916 of 2019.

3. According to the petitioner, there is a wrong entry under the UDR and it has to be rectified. The appropriate authority to effect such rectification is the first respondent. Therefore, the petitioner is seeking to direct the first respondent to consider his representation and pass appropriate orders.

4. The further contention of the petitioner is that he is aged about 74 years. Hence, stipulated time may be granted to the first responders to pass orders. Accordingly, the first respondent is directed to issue notice to the petitioner as well as to respondents 2 to 4, conduct an enquiry and pass appropriate orders within a period of five months from the date of receipt of a copy of this order. It is also submitted that, at the time of entering the names of respondents 2 to 4 in the register, no notice was issued to the petitioner. If any correction is to be made in the UDR records, notice has to be issued to the affected parties.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
