PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to direct the Additional Subordinate Court, Dindigul to expeditiously dispose the proceedings in E.P. No. 192 of 2017 on the file of the Additional Subordinate Court, Dindigul within time framed by this Court. For Petitioners :

Heard Mr. R.Venkatesan, Learned Counsel for the Petitioner and Mr. S.R.A.Ramachandran, Learned Counsel for the First Respondent, and perused the materials placed on record, apart from the pleading of the parties. 2.

This Civil Revision Petition under Article 227 of the Constitution of India has been filed to expedite the disposal in E.P. No. 192 of 2017 on the file of the Additional Subordinate Court, Dindigul (hereinafter referred to as 'the Trial Court' for short).

This Court, during earlier hearing on 26.04.2024, had passed the following order:- "2.

The Additional Subordinate Court, Dindigul shall send a report as to whether there is any impediment for conducting further proceedings in E.P. No. 192 of 2017 and if so, shall explain the reasons for the same, before the next hearing."

In furtherance to the said order, the Trial Court has sent a report dated 28.05.2024, which reads as follows:- "I humbly submit that EP No. 192/2017 was filed for Attach and Sale of Movable properties against Government as per the order passed in L.A.O.P. No. 41/1996 dated 20.01.2009 of Principal Sub Court, Dindigul. On 11.08.2023, Petitioner side enquiry was heard and there was no representation on the side of 1st Respondent and hence reserved for orders on 30.08.2023. 3/7

I humbly submit that on 30.08.2023, while perusing the case records it is seen that the date of order (20.01.2009) mentioned in the first page of Ex-Order differ from the date of order (28.01.2009) mentioned in the last page of the Ex-Order, hence reopened for clarification regarding the date of Ex-Order and posted on 31.08.2023. I further humbly submit that on 31.08.2023 at request of both sides this case was posted on 07.09.2023 for clarification regarding the date of order and to ehar both sides and at request of both sides this case was posted to 15.09.2023, 25.09.2023 and on 25.09.2023, respondent No.1 represented that settlement is going on and may be posted for reporting settlement. Hence, this case was posted for reporting settlement on 16.10.2023. " I humbly submit that on 16.10.2023, at request of both sides this case was posted to 10.11.2023 and on 10.11.2023, there was no representation on both sides and hence posted to 23.11.2023 where on 23.11.2023, Petition 4/7

under Section 151 CPC filed and posted as check and Call on 29.11.2023 and on 29.11.2023, the petition under section 151 CPC checked and returned and this case was posted for reporting settlement on 18.01.2024. I humbly submit that on 18.01.2024, at request of both sides, this case was posted on 09.02.2024 for reporting settlement but there was no representation on both sides. In the interest of justice, to report settlement if any this case was posted to 11.03.2024, 25.03.2024 and 25.04.2024 and on 25.04.2024 at request of both sides this case was posted to 04.07.2024 for reporting settlement if any."

Having regard to the contents of the said report, there shall be a direction to the learned Additional Subordinate Judge, Dindigul, to dispose of the E.P. No.192 of 2017, within a period of six months from the date of receipt of a copy of this order.

In the result, the Civil Revision Petition is disposed on the aforesaid terms. No costs.
