Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent to change the classification as per the recommendation of the 2nd respondent, dated 16.10.2020 in Na.Ka.Aa3/6229/2020 and consequently direct the 3rd respondent to issue patta in favour of the petitioner in respect of T.S.No.6/2 in Ward 'A', Block -22 situated at Devakottai Town.

O R D E R

Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents 1 and 2.

The learned counsel for the petitioner would submit that an application has been made to the District Revenue Officer/1st respondent to correct the classification of the petitioner's property, which has been wrongly mentioned as poramboke lands. It is seen that the petitioner has made a representation in this regard and the 2nd respondent has also recommended by proceedings, dated 16.10.2020 for re-classifying the lands.

3. However, the learned Additional Government Pleader would submit that the Commissioner of Land Administration will have to approve any such reclassification and the application of the petitioner is pending before the District Collector for field inspection to be carried out. 2/4

In view of the above, this writ petition is disposed of with a direction to the 1st respondent to conclude enquiry and forward the report to the Commissioner of Land Administration, Chennai for necessary approval and subject to the decision of the Commissioner of Land Administration, the petitioner's application for reclassification shall be considered. The said exercise shall be completed within a period of twelve (12) weeks from the date of receipt of copy of this order.

5. With the above directions, this Writ Petition stands disposed of. No costs.
