Respondents PRAYER: This petition is filed under Section 482 of Cr.P.C., praying to order transfer of investigation conducted by the second respondent in Crime No.140 of 2015, pending on the file of the Sub Inspector of Police, Thirukoshtiyur Police Station, the third respondent herein, to the fourth respondent herein for a fair and speedy investigation within a reasonable time.

O R D E R

The petitioner has filed this criminal original petition, under Section 482 of the Code of Criminal Procedure, seeking transfer of investigation in Crime No.140 of 2015, from the file of the third respondent Police to the file of the fourth respondent Police, for fair and speedy investigation.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

3. It is seen that the petitioner's son by name Arun, aged about 25 years, was found dead on 19.12.2015, and his body was found hanging in a tamarind tree and in connection with which a case, in Crime No.140 of 2015, under Section 174 Cr.P.C., was registered by the third respondent Police and investigation is in progress. The petitioner is not satisfied with the investigation by the third respondent Police and therefore she has filed this petition seeking the relief as stated above. https://hcservices.ecourts.gov.in/hcservices/

4. Taking into consideration the nature of allegations made in the F.I.R., this Court is of the view that this is not a fit case to direct the respondent Police for transfer of investigation. However, the Deputy Superintendent of Police, Thiruppathur Sub-Division, Sivagangai District, is directed to monitor the investigation in Crime No.140 of 2015, pending on the file of the third respondent Police. The Investigation Officer is directed to complete the investigation as expeditiously as possible and after completion of investigation, he is directed to furnish a copy of the final report to the petitioner so as to enable her to workout her remedy in the manner known to law.

5. With the above directions, this criminal original petition is disposed of.
