For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Cr.No.10 of /2019 on the file of the respondent police.

ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 120 B, 420, 465, 468, 471 of IPC, in Crime No.10 of 2019, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that submitted that the petitioner working as temporary coolie worker in the Forest Department and he has been falsely implicated in the above case. He further submitted that already A3 & A4 were arrested and remanded to judicial custody and by this time, the major portion of the investigation might have been completed and therefore, he prayed to grant anticipatory bail to the petitioner.

4.Per contra, the learned Additional Public Prosecutor appearing for the respondent has submitted that totally four accused involved in this case and all of them criminally conspired and obtained sum of Rs.8,00,000/- from two persons by giving false promise that they will arrange for job in the Forest Department and subsequently they did not arrange for any such job and also refused to return the aforesaid amount. He further submitted that already A3 & A4 were arrested and remanded to judicial custody and since the petitioner also involved in the aforesaid crime, the custodial interrogation of the petitioner is absolutely necessary. Hence, he strongly opposed this petition.

5.Taking into consideration of the allegation made against the petitioner and other accused persons that they gave promise that they will arrange for a job in the Forest Department and received a sum of Rs.8,00,000/- from two persons and subsequently, they did not get any job and also refused to return the said amount and also the fact that the petitioner and other persons have issued a fake order of appointment, and also the submission made by the learned Additional Public Prosecutor that the custodial interrogation of the petitioner is absolutely necessary, this Court is not inclined to grant anticipatory bail to the petitioner.
