Prayer: This Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to consider the petitioner's Trust representation dated 03.04.2021 and consequently, directing the respondents to allot the land in Survey No.489/1 to an extent of 4.00.0 Hector in Thiruvathavoor Village, Melur Taluk and issue patta in the name of "Annai Therasa Trust". ORDER
This writ petition has been filed for the issue of writ of Mandamus directing the respondents to consider the representation made by the petitioner, on 03.04.2021, wherein, the petitioner has sought for issuance of patta to Annai Therasa Trust in the subject property on the ground that the petitioner wants to carry on with welfare activities for the needy people.
2.Heard Mr.S.J.Chakkravarthy, learned counsel appearing for the 1/3
petitioner and Mr.M.Lingadurai, learned Government Advocate, appearing for the respondents.
3.This Court has carefully considered the submissions made on either side and the materials available on record. 4.In the considered view of this Court, there is absolutely no material to show that the so called trust is actively carrying on with any welfare activities. Except the trust deed, dated 31.01.2013, there is no other material to substantiate the claim made by the petitioner. The petitioner is seeking for a claim to allot a huge extent of land for carrying on with the welfare activities.
5.The learned Government Counsel appearing on behalf of the respondents submitted that the petitioner does not have any legal right to seek for such allotment and there are absolutely no merits in the writ petition.
6.In the considered view of this Court, this Court does not find any merits in the writ petition and the claim made by the petitioner is totally unsubstantiated.
7.In the result, this writ petition is dismissed. No costs.
