For Respondent : Mr.B.Nambi Selvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1039 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 174(3) of Cr.P.C @ 306 IPC in Crime No.1039 of 2020, on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner harassed the de-facto complainant's daughter by demanding dowry, due to which, the deceased committed suicide. Hence, the complaint. 3.No doubt, the petitioner's earlier application was dismissed by this Court in Crl.O.P.(MD)No.5584 of 2022, dated 01.04.2022. It is pertinent to note that earlier, the petitioner filed anticipatory bail application before the learned Principal District and Sessions Judge, Thanjavur and the same was allowed and thereafter, on the petition filed by the de-facto complainant before this Court, anticipatory bail was cancelled, vide order, dated 29.09.2021 in Crl.O.P.(MD)No.2615 of 2021.
4.Considering the above facts and circumstances and the seriousness and gravity of the offence alleged and also facts that the investigation is not yet completed and that there is no change https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.7941 of 2022 in circumstances, since the dismissal of the earlier petitions, this Court is not inclined to grant anticipatory bail to the petitioner. 5.In the result, this Criminal Original Petition is dismissed. sd/- 03/08/2022 / TRUE COPY / /08/2022 Sub-Assistant Registrar (C.S.)
