COMMON PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to remove the petitioners' name from History Sheet opened in History Sheet Nos.869, 871, 872 & 870 of 2022 respectively on the file of the 4th respondent office within a stipulated time that may be fixed by this Court.
(In all Writ Petitions) For Petitioner : Mr.R.Karunanidhi, for Henri Patrick Tiphange, For Respondents : Mr.R.Meenakshi Sundaram, Additional Public Prosecutor COMMONORDER These Petitions have been filed to direct the respondents to remove the petitioners' name from History Sheet opened in History Sheet Nos. 869, 871, 872 & 870 of 2022 respectively on the file of the 4th respondent, by considering the petitioners' representation dated 27.03.2024.
2. When the matter was heard, the learned counsel for the petitioners would submit that the petitioners have sent representations to the respondents on 27.03.2024, seeking closure of History Sheets opened 2/5
in their names and the respondents may be directed to consider their representations in accordance with the Police Standing Orders and the law laid down by this Court.
3. In view of the limited prayer sought for by the petitioners, this Court is inclined to direct the second respondent to consider the petitioners' representation, in the light of the decision of this Court in W.P.(MD)Nos.21040 of 2018 etc. batch, dated 03.07.2020 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioners.
