For Respondent : Mr.R.Menakshi Sundaram, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.15 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 20 (b)(ii)(B) r/w 8(c) of NDPS Act, in Cr.No.15 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that based on the secret information received, the respondent Police conducted raid and they found that the accused was in possession of Ganja weighing 1.100 kgs. Hence, the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor appearing for the State would submit that the entire contraband was recovered from the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.7720 of 2022 first accused and only on the basis of the confession statement given by him, the petitioner was added as an accused. He would further submit that the petitioner is having three previous cases under NDPS Act, in which, two cases were already disposed of and one case is pending.
5.Considering the above facts and also the fact that the petitioner is having three previous cases under the NDPS Act, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, the Criminal Original Petition is dismissed. sd/- 26/04/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
