Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the second respondent to complete the enquiry and dispose the petitioner's appeal dated 16.04.2021 seeking to cancel the Patta No.2588 and issue patta in favour of the petitioner for the property situated in Survey No.144/3 consists of 90 cents in the existing Patta No.419 situated at Naranapuram Village, Thiruthangal, Sivakasi Block, Virudhunagar District within stipulated time frame fixed by this Court.

ORDER

This Writ Petition has been filed for a limited relief. The petitioner seeks for early disposal of the statutory appeal dated 16.04.2021 pending on the file of the second respondent. https://hcservices.ecourts.gov.in/hcservices/ 1/2

2. Aggrieved by the issuance of patta in favour of the fourth respondent, the petitioner has filed the statutory appeal before the second respondent. The said statutory appeal is still pending.

3. No prejudice would be caused to the respondents, if a direction is issued by this Court to the second respondent to pass final orders on the petitioner's statutory appeal within a time frame to be fixed by this Court.

4. For the foregoing reasons, this Court directs the second respondent to pass final orders on the petitioner's statutory appeal dated 16.04.2021 seeking for cancellation of Patta No.2588 issued in favour of the fourth respondent, after affording a fair hearing to the petitioner and the fourth respondent as well as any other necessary party, whom the second respondent deems fit to enquire, within a period of three (3) months from the date of receipt of a copy of this order.

5. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
