No.3718 of 2020 :- This Criminal Misceallneous Petition filed under Section 482 of Crl.P.C. to MODIFY the condition that the petitioner shall deposit original invoice copy of the machine and deposit lesser amount as fixed by Honble High Court instead of deposit original Registration Certificate of the vehicle and shall deposit a sum of 5,00,000 within a period of four weeks from the date of receipt of a copy of this order and allow this petition.

Prayer in CRL RC(MD). 392/ 2020 :

This Criminal Revision case filed under Sections 397 r/w. 401 of Cr.P.C., to call for the records relating to the order passed by the learned Special Court under the Mines and Minerals (Development and Regulation) Act, 1957, Thanjavur in Cr.M.P.No.1741 of 2020, dated 15.06.2020 and set aside the same and allow this revision petition.

ORDER:- This Criminal Misceallneous Petition coming upon for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.Subash Babu, Advocate for the Petitioner and of M/s.M.Anandhi Devi., Government Advocate for the respondent, this Court made the following order:

This petition has been filed to modify the condition that the petitioner shall deposit the original invoice copy of the machine and to deposit lesser amount.

CRL MP(MD). No.3718 of 2020 vide order dated 07.07.2020 imposed the first condition to the effect that the petitioner shall deposit the original registration certificate of the vehicle. However, there is no R.C. Book for JCB vehicle. Only original invoice is available.

3.In view of the above, this petition is partly allowed in respect of the first condition of the order in Crl.R.C.(MD)No.392 of 2020 alone and it is modified to that effect that the petitioner shall deposit the original invoice of the vehicle. The other conditions of the order remains unaltered.
