RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify from Learned Additional Mahila court, Kanyakumari district at Nagercoil to Judicial magistrate, Tiruchendur in Crl M.P (MD) No. 4711 of 2022 in Crl O.P (MD) no. 16381 of 2021 in Cr. No. 14 of 2021 dated 12.04.2022 for the petitioner Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.S.VARATHARAJAN, Advocate for the petitioner and of MR.R.M.S.SETHURAMAN, Additional Public Prosecutor (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition is filed to modify the jurisdictional Court as the learned Judicial Magistrate, Tiruchendur, instead of the learned Additional Mahila Court, Kanyakumari District at Nagercoil.
2. This Court, on 27.10.2021, in Crl.O.P.(MD)No.16381 of 2021, granted anticipatory bail to the petitioner on condition that the petitioner is ordered to be released on bail in the event of arrest or on her appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judge, Additional Mahila Court, Kanyakumari District at Nagercoil and on further condition that the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties 1/3
each for a like sum to the satisfaction of the learned Judge, Additional Mahila Court, Kanyakumari District at Nagercoil concerned.
3. The grievance of the petitioner is that since she is now residing with her family members at Srivilliputhur, she is not able to find out any persons at Nagercoil to stand as sureties on behalf of her. Therefore, she is not a position to furnish the sureties before the learned Additional Mahila Court, Kanyakumari District at Nagercoil.
4. Considering the reasons stated by the petitioner, this petition is allowed as prayed for. The petitioner is permitted to appear before the learned Judicial Magistrate, Tiruchendur and execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Tiruchendur. All other conditions imposed by this Court in Crl.O.P.(MD)No.16381 of 2021 shall remain unaltered.
5. The learned Judicial Magistrate, Tiruchendur, shall accept the sureties produced by the petitioner.
6. Time already granted by this Court to comply with the conditions is extended by ten days from the date of receipt of a copy of this order.
