O R D E R

This Civil Revision Petition has been filed to direct the learned Subordinate Judge, Thoothukudi to dispose of the petition in H.M.O.P.No.120 of 2012 within a time stipulated by this Court.

2. The learned counsel for the petitioner would aver among other things that H.M.O.P. 120 of 2012 is pending for more than five years. Though proof affidavit has been filed on 24.01.2017 and the case is posted specifically for the appearance of R.W.1, they have not turned up. The matter is being dragged on for the past five years without any just and reasonable cause and therefore, the petitioner has come forward with the present Civil Revision Petition for early disposal of H.M.O.P.No.120 of 2012. 3.Since it is only a petition for early disposal of the above HMOP, no notice is necessary to the respondent herein.

4. Considering the facts and circumstances of the case and considering the fact that the HMOP is of the year 2012, this Court feels that ends of justice would be met by directing the Court below to dispose of H.M.O.P.No.120 of 2012 within a time frame. Without adverting to the merits of the case, a direction is issued to the learned Subordinate Judge, Thoothukudi, to dispose of H.M.O.P.No.120 of 2012 within a period of three months from the date of receipt of a copy of this order.

5. With the above direction, this Civil Revision Petition is disposed of. No costs.
