PRAYER: Civil Revision Petition is filed, under Article 227 of the Constitution of India, to expedite the Trial in O.S.No.163 of 2013, on the file of II Additional District Court, Tiruchirappalli within the stipulated time period in the interest of justice. For Petitioner : Mr. C. Muthusaravanan
ORDER
The petitioner has filed this Civil Revision Petition to expedite the Trial in O.S.No.163 of 2013, on the file of II Additional District Court, Tiruchirappalli within the stipulated time period.
2.The petitioner filed O.S.No.163 of 2013 before the District Court, Trichirappalli for recovery of Rs.40,01,842/- from the respondent.
3.The learned counsel appearing for the petitioner submitted that the respondent filed the Civil Revision Petition in C.R.P(MD) No.373 of 2016 before this Court against the order passed in I.A (S.R)No.2864 of 2015 in O.S.No.163 of 2013. By the order dated 15.02.2016 the said C.R.P(MD)no.373 of 2016 was dismissed by this Court. Already this Court, by the order dated 13.11.2015 directed the District Judge, Tiruchirappalli to dispose the suit in O.S.No.163 of 2013 on or before January, 2016. Inspite of the orders of this Court, the suit is not disposed of. He further submitted that already both parties have let in evidence and arguments were heard by the learned Judge and both parties filed the written arguments. In the circumstances, the petitioner has come out with the present Civil Revision Petition for early disposal of suit in O.S.No.163 of 2013.
4.I have heard the learned counsel appearing for the petitioner and also perused the entire materials on record. https://hcservices.ecourts.gov.in/hcservices/
5.Taking into consideration of the material facts and circumstances and contention of learned counsel for petitioner that both the parties have completed their evidence and learned counsel for parties have argued the matter and filed written arguments, this Court is of the view that in the interest of justice, it may be expedient to issue a direction to the learned District Judge, Trichirappalli.
6.Accordingly, this Civil Revision Petition is allowed and the learned District Judge, Trichirappalli, is directed to dispose of suit in O.S.No.163 of 2013, as expeditiously as possible, in any event, not later than, 31st March, 2017.
