Civil Revision Petition filed under Article 227 of Constitution of India to direct the learned District Munsif, Melur to dispose of O.S.No.205 of 2018, within a time frame. For Petitioner :

ORDER

To direct the learned District Munsif, Melur to dispose of O.S.No.205 of 2018, within a time frame, the revision petitioner has filed this Civil Revision Petition.

2.Heard the learned counsel appearing for petitioner and perused the materials available on record.

3.The revision petitioner/second defendant has filed this revision petition seeking for a direction to the learned District Munsif, Melur to dispose of O.S.No.205 of 2018 within a time frame. But he has filed a petition for appointment of Commissioner in I.A.No.2 of 2021, in the pending suit and the same is still pending. Without disposing the I.A.No.2 of 2021, the Court cannot conduct trial in the main suit. After filing petition in I.A.No.2 of 2021, the revision petitioner has filed this petition seeking for speedy disposal. The delay is caused only by the petitioner. The act of the petitioner has clearly shown his intention to drag on the proceedings, which leads to waste of the precious time of the Court. In view of the above, this Court is inclined to dismiss this revision petition, with exemplary cost of Rs.5,000/-. 4.Accordingly, this Civil Revision Petition stands dismissed and the revision petitioner is hereby directed to pay a sum of https://hcservices.ecourts.gov.in/hcservices/ 1/2

C.R.P(PD)(MD).No. 1015 of 2022 Rs.5,000/- (Rupees Five Thousand only) towards costs, to the credit of Government of Tamil Nadu, CMPRF in IOB, Secretariat Branch, Chennai-9 (Account No.11720 10000 00070, IFSC Code: IOBA0001172) within a week, from the date of receipt of a copy of this order.
