This Writ Petition has been filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents 1 to 3 to consider the petition of the petitioners, dated 10.08.2015 to provide houses to the houseless scheduled caste people of Alampattipudur as per the proceedings of the Government in 2116/m2/m4/ehs; 24.11.1994.

ORDER

The Writ Petition has been filed praying for a Writ of Mandamus directing the respondents 1 to 3 to consider the petition submitted by the petitioners, dated 10.08.2015 to provide houses to the houseless scheduled caste people of Alampattipudur as per the proceedings of the Government in 2116/m2/m4/ehs; 24.11.1994.

2. Mr.S.Kumar, learned Additional Government Pleader takes notice for the respondents.

3. By consent the Writ Petition itself is taken up for disposal.

4. The case of the petitioners is that the petitioners are the residents of Alampattipudur, Inamkulathur Village, Srirangam Taluk, Trichy District and they are doing agricultural coolie works and they are not having house or house sites. Therefore, the petitioners approached the third respondents to provide houses to them. Hence, the Government have come forward to construct forty houses as per proceedings of the Government in 2116/m2/m4/ehs; 24.11.1994. Thereafter, the third respondent had taken list of forty scheduled caste houseless people like the petitioners. But till date the houses are not constructed for the petitioners. Hence, the petitioners approached the third respondent on 10.08.2015 to help the petitioners by providing houses to them. But, till date no steps have been taken by the third respondent. Hence, the petitioners have come forward with the Writ Petition for the above stated relief.

Considering the submissions made on either side, without going into the merits of the matter, this Court directs the third respondent to consider the representation of the petitioner, dated 10.08.2015 and pass appropriate orders, on merits and in accordance with law by affording an opportunity of hearing to the petitioners, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim

made by the petitioners and it is for the third respondent to consider the same purely on merits.

With the above direction, the Writ Petition is disposed of. No Costs.
